To establish a link from your web site to the PRDnationwide links page you need to:

1. complete the Application in Part A;
2. read and accept the Terms and Conditions in Part B.  By clicking the "I agree" button, you agree that the Terms and conditions in Part B constitute part of you application to PRD Realty Pty Ltd and you warrant that the information provided by you in the Application in Part A is true and correct;
3. submit your completed Application to PRD Realty Pty Ltd, PRDnationwide will then send you a confirmation email.
4. once your application has been confirmed by PRD Realty Pty Ltd, comply with all the Terms and Conditions in Part B.

1  What this allows you to do
PRD Realty Pty Ltd (PRDnationwide) grants you a non-exclusive licence on these terms and conditions to establish and maintain a hypertext link from your web site to the PRDnationwide web site links page.

2  This does not allow or otherwise grant to you any right to
2.1  use the name PRDnationwide or any derivation of that name except as set out in paragraph 4;
2.2  use any PRDnationwide trademark, service mark, trade name or logo;
2.3  claim any sponsorship, endorsement, approval, affiliation or other association with PRDnationwide or PRDnationwide's related bodies corporate.

3  You acknowledge that
3.1  PRDnationwide does not warrant that you or other person will have continuous access to the PRDnationwide web site.  PRDnationwide will not be liable in the event that the PRDnationwide web site is unavailable to you or any other person due to any reason whatsoever; and
3.2  the use of the PRDnationwide web site by you or any other person is subject to and governed by the terms and conditions of use of the PRDnationwide posted on the PRDnationwide web site from time to time

4  What must the hypertext link look like
The format of the hypertext link from the PRDnationwide web site home page is limited to the name of the company, a small logo and a very brief description of the company.

5  You must ensure that your web site and any site linked from your web site
5.1  does not or could not reasonably be considered to imply any sponsorship, endorsement, approval, affiliation, or other association with PRDnationwide or PRDnationwide's related bodies corporate
5.2  does not contain content that adversely affects, or could reasonably be considered to adversely affect, PRDnationwide's reputation and goodwill by association with such web site, including but not limited to any content that is defamatory or pornographic;
5.3  is not, or could not reasonably be considered to be, in breach of the Broadcast Services Amendment (Online Service) Act 1999 (Cth); the Trade Practices Act 1974 (Cth); or any other applicable law or applicable industry code;
5.4  does not contain, or could not reasonably be considered to contain, any misrepresentations and is not, or could not reasonably be considered to be, misleading or deceptive or likely to mislead and deceive and is not otherwise unlawful; and
5.5  does not, or could not reasonably be considered to be, in breach of PRDnationwide (or its related bodies corporate) or any other person's intellectual property rights.

6  You must not
6.1  claim any sponsorship, endorsement, approval, affiliation or other association with PRDnationwide or PRDnationwide's related bodies corporate by virtue of this licence;
6.2  make any representation about the products or services suppled by PRDnationwide without PRDnationwide's prior written consent;
6.3  copy, alter, modify or reproduce the PRDnationwide web site or any material or information contained or posted on the PRDnationwide web site; or
6.4  sub-license, rent, lease, lend or grant any rights to the PRDnationwide web site or any material or information contained or posted on the  PRDnationwide web site; or
6.5  assign, transfer or authorise anyone else to exercise the rights in any licence granted pursuant to these terms and conditions.

7  You must indemnify PRDnationwide 
You agree to indemnify PRDnationwide against any loss, costs (including legal fees), expenses, demands or liability, whether direct or indirect for any claim or claims arising from:
(a)  a breach by you of these terms and conditions;
(b)  any wilful, unlawful or negligent act or omission by you; or
(c)  any third party's use of your web site.

8  PRDnationwide limits its liablity to the extent permitted by law, PRDnationwide, its directors, employees, agents and consultants expressly exclude all liability for any loss or damage (including direct, indirect, special or consequential loss or damage) arising from or in connection with your hypertext link to the PRDnationwide home page.

9  PRDnationwide can terminate this agreement at any time, with or without cause, by immediate notice to you by email or any other means.  Upon termination you will immediately cease to host the Hypertext link to the PRDnationwide web site home page.

10  PRDnationwide reserves the right to modify or amend these terms and conditions.  These modifications or amendments will be binding on all parties once displayed on the PRDnationwide web site.  You have to ensure you comply with the amended terms and conditions and should check this page regularly.
